Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Aha Moment (“Aha Moment,” “we,” “us,” or “our”) at ahamoment.studio and related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service

Aha Moment surfaces and organizes pain points and related signals aggregated from publicly available online discussions, intended to help you find problems worth solving. The Service, including all data, rankings, and research, is provided for informational purposes only.

Accounts

You must provide accurate information when creating an account and are responsible for activity under your account. You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. Keep your login credentials secure and notify us of any unauthorized use.

Subscriptions and billing

• Paid plans (“Pro”) are billed in advance on a recurring monthly basis through our payment processor, Stripe, at the price shown at checkout.
• Your subscription renews automatically until canceled. You can cancel anytime from your account; cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
• We may change our prices. Any price change will apply to billing periods after we give you notice; introductory or launch pricing applies only as described at the time of purchase.

Acceptable use

You agree not to:

• Scrape, crawl, harvest, resell, or redistribute the Service’s data or content, or use automated means to access the Service beyond normal personal use.
• Share, resell, or sublicense your account or access with others.
• Attempt to bypass paywalls, access controls, rate limits, or security measures, or access areas of the Service you are not authorized to use.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any unlawful purpose or in violation of these Terms.

We may suspend or terminate access that we reasonably believe violates these Terms.

Intellectual property

The Service, including its design, text, compilation of data, and software, is owned by Aha Moment and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal use, subject to these Terms. The ideas and pain points themselves are not owned by us, and you are free to act on them — but the curated dataset and presentation are ours.

No guarantees; informational use

The Service aggregates third-party and publicly sourced information and presents estimates, rankings, and trends. We do not guarantee the accuracy, completeness, or timeliness of any data, and nothing on the Service constitutes business, financial, legal, or investment advice. Any decisions you make based on the Service are your own responsibility.

Third-party services

The Service relies on third parties (including Supabase, Stripe, Resend, Vercel, and Google) and may link to external sites. We are not responsible for the content, policies, or practices of third parties.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, Aha Moment will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the jurisdiction in which Aha Moment operates, without regard to conflict-of-law principles. (Update this section to specify your governing state or country.)
